Where’s Our Money?

I thought the band Alabama was immune to drama. There never seems to be any negative publicity for the teflon coated band, until now. Apparently, Alabama needs to hang their accountant. Their drummer, Mark Herndon, was overpaid by over $200,000 for merchandise sales from their 2003 “American Farewell Tour.” They actually paid him before the accounting was finalized for that year. Randy Owen, Teddy Gentry, and Jeff Coof are suing Herndon for the overpaid amount. It is stated by the suit, that ”there were no net merchandise revenues as defined by the contract.” During this law suit, Herndon is asking for $65,047 as an advance on his share from the upcoming album The Last Stand, a live concert album which will be sold at Cracker Barrel. The suit is trying to withold any future earnings from Herndon, until the overpayment is back in the hands of the band. I think Herndon will win this suit. It is their mistake for the miscalculation. They should have never paid him for that amount up front. That would be like promising somebody $450 to do a show, and then when the show is over, he/she was only given $250. Now I know this a little bit more money, but it’s the same principle.
